Together, the speakers provided legal context and practical guidance for employees facing a reduction in force, or RIF.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-key-takeaways-nbsp\">Key takeaways&nbsp;<\/h3>\n\n\n\n<p>The Supreme Court\u2019s decision in AFGE v. Trump allows certain agencies to proceed with mass layoffs and restructuring efforts. The ruling does not apply to every federal agency but <a href=\"https:\/\/www.civilservicestrong.org\/resources\/you-are-not-alone-a-resource-guide-for-civil-servants-affected-by-the-supreme-court-s-rif-decision#:~:text=2.%20Which%20agencies%20are%20impacted%20by%20this%20decision%3F\" target=\"_blank\" rel=\"noreferrer noopener\">it does impact over 20 of them<\/a>. The decision was not about the legality of specific agency reorganization plans, and litigation on these matters is still ongoing.&nbsp;<\/p>\n\n\n\n<p>This ruling exacerbates the challenging and complex legal landscape for federal employees seeking to contest a RIF decision, particularly when paired with strict, time-sensitive deadlines to file an appeal.&nbsp;<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-advice-for-federal-employees-nbsp\">Advice for federal employees&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Stay informed:<\/strong> Monitor agency notices and union updates closely for legal updates.&nbsp;<\/li>\n\n\n\n<li><strong>Seek support early: <\/strong>Contact unions or <a href=\"https:\/\/workerslegaldefense.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal defense networks<\/a> if you have any questions about receiving a RIF notice.&nbsp;<\/li>\n\n\n\n<li><strong>Know your rights:<\/strong> <a href=\"https:\/\/ourpublicservice.org\/blog\/merit-systems-protection-board-mspb-appeal-process-ray-limon-fedsupport-webinar-federal-employee-explainer-series\/\" target=\"_blank\" rel=\"noreferrer noopener\">Appeals to the Merit Systems Protection Board<\/a> remain available, but deadlines are short. Even if an appeal is pursued, preparing for alternative paths can provide greater security.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-paths-to-appeal-rif-decisions\">Paths to appeal RIF decisions<\/h3>\n\n\n\n<p>Depending on individual circumstances, employees may have different routes to appeal a RIF. These are some to be aware of:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Merit Systems Protection Board: <\/strong>Reviews whether rules and <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/workforce-restructuring\/reductions-in-force-rif\/rif-basics.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">retention registers<\/a> were followed (typically within 30 days). The retention register lists employees in a specific job category and ranks them to determine who is retained or separated.&nbsp;<\/li>\n\n\n\n<li><strong>Union grievances:<\/strong> Available under collective bargaining agreements for unionized employees.<\/li>\n\n\n\n<li><strong>Equal Employment Opportunity Commission complaints:<\/strong> Complaints can be filed if discrimination is suspected (race, gender, age, disability, etc.).<\/li>\n\n\n\n<li><strong>Office of Special Counsel:<\/strong> Available for retaliation or whistleblower cases.<\/li>\n\n\n\n<li><strong>Judicial review:<\/strong> In limited cases, employees can appeal MSPB rulings to federal court.<\/li>\n<\/ul>\n\n\n\n<p>While these avenues remain open, they come with strict timelines and procedural requirements that can be difficult to navigate without preparation. Understanding the distinctions among these options is key to mounting an effective response.&nbsp;<\/p>\n\n\n\n<p>Employees who are part of a union may have access to additional or different appeal options and should contact their union representatives for more information.
