They tackled some of the most pressing questions from federal employees navigating <a href=\"https:\/\/ourpublicservice.org\/partnership-perspective-on-executive-orders\/\" target=\"_blank\" rel=\"noreferrer noopener\">current civil service disruptions<\/a>.\u00a0<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-is-the-merit-systems-protection-board-nbsp\">What is the Merit Systems Protection Board?&nbsp;<\/h3>\n\n\n\n<p>The MSPB is an independent federal agency that hears appeals from federal employees regarding <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/senior-executive-service\/adverse-actions\/\" target=\"_blank\" rel=\"noreferrer noopener\">adverse actions<\/a> including removals, suspensions, demotions and whistleblower claims.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Outside of the appeals process, the MSPB conducts and compiles <a href=\"https:\/\/www.mspb.gov\/studies\/featured.htm\" target=\"_blank\" rel=\"noreferrer noopener\">research<\/a> on the federal merit system.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The MSPB only hears and decides cases regarding an adverse action.&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <a href=\"https:\/\/www.eeoc.gov\/overview\" target=\"_blank\" rel=\"noreferrer noopener\">Equal Employment Opportunity Commission<\/a> hears discrimination complaints.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <a href=\"https:\/\/www.flra.gov\/about\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Labor Relations Authority<\/a> handles unfair labor practices.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <a href=\"https:\/\/osc.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">Office of Special Counsel<\/a> investigates prohibited personnel practices.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-who-can-appeal-to-the-merit-systems-protection-board-nbsp\">Who can appeal to the Merit Systems Protection Board?&nbsp;<\/h3>\n\n\n\n<p>Most General Schedule employees can appeal to the MSPB, but <a href=\"https:\/\/ourpublicservice.org\/blog\/federal-employee-probationary-period-rights-federal-employee-explainer-series-webinar\/\" target=\"_blank\" rel=\"noreferrer noopener\">probationary employees have limited appeal rights<\/a>. Senior Executive Service members often cannot appeal to the MSPB.&nbsp;&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.commerce.gov\/sites\/default\/files\/2018-12\/understanding-form-sf-50.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Consult your SF-50<\/a> to find your employee status and confirm your eligibility to appeal.&nbsp;<\/p>\n\n\n\n<p>If you are a member of a bargaining unit, the appeals process may be different. Check Box 37 of your SF-50 to confirm your collective bargaining status.&nbsp;<\/p>\n\n\n\n<p>If your position is not covered by a bargaining agreement, the code is \u201c8888\u201d and if your position is eligible and no unit exists, the code is \u201c7777.\u201d&nbsp;<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-do-i-file-an-appeal-nbsp-nbsp\">How do I file an appeal?&nbsp;&nbsp;<\/h3>\n\n\n\n<p>To file a MSPB appeal, visit the <a href=\"https:\/\/e-appeal%20online%20website\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><a href=\"https:\/\/e-appeal.mspb.gov\/etk-mspb-appeals-prod\/login.request.do\" target=\"_blank\" rel=\"noreferrer noopener\">e-Appeal website<\/a>, which will guide you through the process. If you do not want to file online, you may download the <a href=\"https:\/\/appeal%20form\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><a href=\"https:\/\/www.mspb.gov\/appeals\/forms\/FORM185-Final-508-9-20-23.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">appeal form<\/a> and file through mail, fax or personal delivery.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The required documents for most appeals are the notice of the proposed action, the agency decision to take the action and the SF-50, if available. Later in the appeals process, you will have opportunities to provide additional information.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Most appeals must be filed within 30 days of the adverse action or the date the notice was received, whichever is later. If you have passed the 30-day deadline, you can still make a claim but must have good cause for the delay.&nbsp;<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-does-the-rest-of-the-appeal-process-look-like-nbsp-nbsp\">What does the rest of the appeal process look like?&nbsp;&nbsp;<\/h3>\n\n\n\n<p>After the appeal is filed, your case will be assigned an administrative judge. The administrative judge will submit an acknowledgement order to both you and the agency.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The acknowledgement order will confirm or deny if your case continues with the MSPB and may ask for additional information to be provided.&nbsp;<\/p>\n\n\n\n<p>Later in the process, there may be a hearing for your appeal, either in-person or virtually. The hearing ensures the administrative judge has the necessary information to make an initial decision.&nbsp;&nbsp;<\/p>\n\n\n\n<p>You should expect an initial decision from the MSPB within 120 days of filing.&nbsp;&nbsp;<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-can-i-appeal-beyond-the-merit-systems-protection-board-nbsp\">Can I appeal beyond the Merit Systems Protection Board?&nbsp;<\/h3>\n\n\n\n<p>If you have received your initial decision from the MSPB and wish to continue the appeal process, there are other avenues available. You may file a petition for review to the three-member MSPB board or <a href=\"https:\/\/www.cafc.uscourts.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Federal Circuit Court of Appeals<\/a>.&nbsp;<\/p>\n\n\n\n<p>Appeals beyond the initial decision are likely to rely on reviewing written records from earlier proceedings rather than hearing new testimony.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-do-settlements-and-class-actions-work-nbsp\">How do settlements and class actions work?&nbsp;<\/h3>\n\n\n\n<p>About half of MSPB disputes that are not dismissed are settled. If a settlement is not brought up, but you wish to pursue this option, contact the agency\u2019s representative for your case to discuss settlement options.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Class actions require upfront participation and generally prevent individuals from filing their own separate lawsuits for the same issue.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-where-should-i-look-for-further-help-nbsp\">Where should I look for further help?&nbsp;<\/h3>\n\n\n\n<p>While legal representation is not required for the appeals process, many find it helpful when navigating complex cases.
