{"id":43796,"date":"2025-02-11T10:54:24","date_gmt":"2025-02-11T15:54:24","guid":{"rendered":"https:\/\/ourpublicservice.org\/?p=43796"},"modified":"2025-03-28T16:39:35","modified_gmt":"2025-03-28T20:39:35","slug":"insights-on-deferred-resignations-probationary-periods-reductions-in-force-and-reassignments-in-the-federal-government-federal-employee-explainer-series-webinar","status":"publish","type":"post","link":"https:\/\/ourpublicservice.org\/blog\/insights-on-deferred-resignations-probationary-periods-reductions-in-force-and-reassignments-in-the-federal-government-federal-employee-explainer-series-webinar\/","title":{"rendered":"Insights on deferred resignations, probationary periods, reductions in force and reassignments in the federal government"},"content":{"rendered":"\n<p>The second webinar in the Partnership\u2019s <a href=\"https:\/\/events.ourpublicservice.org\/federal-employee-explainer-webinar-series\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Employee Explainer Series<\/a> addresses federal employees\u2019 questions about how recent presidential actions related to workforce restructuring might affect them, focusing on deferred resignations, probationary periods, reductions in force and reassignments.&nbsp;<\/p>\n\n\n\n<p>The webinar features Valerie Smith Boyd, director of the Partnership\u2019s <a href=\"https:\/\/presidentialtransition.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Center for Presidential Transition\u00ae<\/a> and guest Ronald Sanders, who served in senior human capital roles at several federal agencies.&nbsp;<\/p>\n\n\n\n<p>Here are some of the top questions they addressed:<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-is-a-deferred-resignation-and-how-does-it-differ-from-a-traditional-buyout-nbsp\">What is a deferred resignation and how does it differ from a traditional buyout?&nbsp;<\/h3>\n\n\n\n<p>To downsize or restructure their organization, agencies authorized by the Office of Personnel Management may offer buyouts, also known as <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/workforce-restructuring\/voluntary-separation-incentive-payments\/\" target=\"_blank\" rel=\"noreferrer noopener\">voluntary separation incentive payments<\/a>. These payments are offered to employees whose positions are surplus or whose skills are no longer needed. <\/p>\n\n\n\n<p>The buyouts <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/workforce-restructuring\/voluntary-early-retirement-authority\/top-10-frequently-asked-questions-about-vera-and-vsip.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">provide a lump sum of up to $25,000<\/a> (or the employee\u2019s severance pay amount, whichever is less) as an incentive to resign voluntarily. OPM may also authorize Voluntary Early Retirement Authority which allows employees with a certain age and years of service to retire early.&nbsp;<\/p>\n\n\n\n<p>The \u201c<a href=\"https:\/\/www.opm.gov\/fork\" target=\"_blank\" rel=\"noreferrer noopener\">Fork in the Road<\/a>\u201d email sent to federal employees by the Trump Administration in recent weeks is not a traditional buyout offer but, instead, a \u201cdeferred resignation,\u201d since it doesn\u2019t include any guarantee of severance payments or any other financial notice, process or incentives that would come with a traditional federal buyout offer.&nbsp;<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-is-the-voluntary-early-retirement-authority-and-who-might-qualify-nbsp\">What is the Voluntary Early Retirement Authority and who might qualify?&nbsp;<\/h3>\n\n\n\n<p>The <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/workforce-restructuring\/voluntary-early-retirement-authority\/top-10-frequently-asked-questions-about-vera-and-vsip.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Voluntary Early Retirement Authority<\/a> allows agencies undergoing restructuring to lower the age and service requirements for retirement&nbsp;to increase the number of employees who are eligible. OPM needs to approve this authority, and it is granted for a limited time.&nbsp;<\/p>\n\n\n\n<p>To qualify for VERA, a federal employee must be at least 50 years old with 20 or more years of service or have at least 25 years of service regardless of age.<\/p>\n\n\n\n<p>According to OPM\u2019s memorandum on the <a href=\"https:\/\/chcoc.gov\/sites\/default\/files\/OPM%20Memo%20Legality%20of%20Deferred%20Resignation%20Program%202-4-2025%20FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Legality of Deferred Resignation Program<\/a> published on Feb.<sup>. <\/sup>4, 2025, employees who accept the deferred resignation offer may receive VERA. Aspects of the program are currently facing legal challenges.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-are-probationary-periods-how-long-do-they-last-and-what-rights-do-federal-employees-have-during-this-time-nbsp\">What are probationary periods, how long do they last and what rights do federal employees have during this time?&nbsp;<\/h3>\n\n\n\n<p>New permanent federal employees in the <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/hiring-information\/competitive-hiring\/\" target=\"_blank\" rel=\"noreferrer noopener\">competitive service<\/a> generally serve a one-year probationary period. Following the probationary period, they transition to a \u201ccareer conditional appointment\u201d until they reach three years of continuous creditable service to attain a permanent career appointment. Probationary periods in the federal government <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/hiring-information\/practical-tips-for-supervisors-of-probationers\/\" target=\"_blank\" rel=\"noreferrer noopener\">can apply to more than just new hires<\/a>.&nbsp;<\/p>\n\n\n\n<p>Depending on an employee\u2019s previous status prior to beginning a new job with a probationary period, federal employees in a probationary period have limited rights to appeal removals or disciplinary actions. However, <a href=\"https:\/\/federalnewsnetwork.com\/workforce-rightsgovernance\/2025\/02\/what-are-the-rules-for-probationary-periods-and-federal-employees\/\" target=\"_blank\" rel=\"noreferrer noopener\">prior federal service in a similar position<\/a> may grant some probationary employees full due process and appeal rights before they complete their probationary period.&nbsp;<\/p>\n\n\n\n<p>To determine if you&#8217;re in a probationary period, review your <a href=\"https:\/\/help.usajobs.gov\/working-in-government\/service\/sf-50\" target=\"_blank\" rel=\"noreferrer noopener\">SF-50 Notification of Personnel Action form<\/a>.&nbsp; It will show your tenure and type of appointment.&nbsp;<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-are-reductions-in-force-nbsp\">What are reductions in force?&nbsp;<\/h3>\n\n\n\n<p>Federal agencies use <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/workforce-restructuring\/reductions-in-force\/\" target=\"_blank\" rel=\"noreferrer noopener\">reductions in force<\/a> to downsize their workforce due to reorganization, lack of work, shortage of funds, insufficient personnel ceiling, the exercise of certain reemployment or restoration rights, or for other reasons.&nbsp;<\/p>\n\n\n\n<p>Agencies must follow formal RIF procedures published by OPM, which outline the process of identifying which positions to terminate and how employees must be notified. &nbsp;<\/p>\n\n\n\n<p>Federal rules require layoff decisions to be based on employees\u2019 tenure status, veteran\u2019s preference, length of service, job performance and whether the employee is part of the competitive or excepted service. <\/p>\n\n\n\n<p>Agencies must give written notice to employees designated for separation through a RIF and usually need to provide at least 60 days notice.
